Consultation meeting by SAARCLAW & ICJ

The South Asian Association for Regional Cooperation in Law (SAARC Law Nepal) and the International Commission of Jurist (ICJ) are organizing a consultation meeting on “Role of Justice Sector Actors on Enhancing Women’s Access to Justice in Nepal.”

The meeting aims to discuss about the opportunities, challenges and way forward to the judicial committees in enhancing women’s access to justice.

Election of New Office Bearers

In 2021 annual general body meeting of SAARCLAW Nepal was held at Aranya Boutique Hotel, Nagpokhari, Kathmandu. The meeting was presided over by president Hon’ble Justice Sapana Pradhan Malla. Discussion Program on “Opportunities & Challenges in ensuring External Voting”

SAARCLAW Nepal organized a Discussion Program on “Opportunities & Challenges in ensuring External Voting” with Law and Policy Forum for Social Justice, LAPSOJ on 16th April, 2019 at Hotel Himalaya, Lalitpur in the presence of Hon’ble Justice Ms. Sapana Pradhan Malla, Chairman, SAARCLAW Nepal and Judge, Supreme Court of Nepal, Hon’ble Justice Mr. Anil Sinha, Judge, Supreme Court of Nepal and other high level delegates. The main agenda of the conference was to highlight the recent judgment on External Voting and discuss the challenges and strategies for ensuring external voting rights.

Discussion Program on “Laws on Child Marriage and Strategies for its Effective Implementation”

SAARCLAW Nepal Chapter organized a Discussion Program on “Laws on Child Marriage and Strategies for its Effective Implementation” on 14th September, 2018 at Hotel Shangri-La, Kathmandu in the presence Hon’ble Agni Prasad Kharel, Attorney General of Nepal along with other delegates. The objectives of the program were:

  • Analyzing the legal provisions against child marriage in Nepal.
  • Elucidating and analyzing the judicial views on child marriage.
  • Contributing ideas and suggestions relating to plans and policies against child marriage.
  • Formulating and presenting sound recommendations regarding reformation and effective implementation of existing laws against child marriage.

Discussion Program on “Sexual and Reproductive Health Rights”

SAARCLAW Nepal Chapter organized a Discussion Program on “Sexual and Reproductive Health Rights” on 8th June, 2018 at Hotel Yak and Yeti, Kathmandu in the presence of Chief Guest Hon’ble Minister Mr. Sher Bahadur Tamang, Ministry of Law, Justice and Parliamentary Affairs along with other delegates. The objective of the program were:

  • Strengthening the understanding that reproductive rights are recognized by the Constitution.
  • Initiating an open and inclusive dialogue on the issue of sexual and reproductive rights.
  • Identifying the way forward for better implementation of judicial decisions pertaining to reproductive rights.
  • Contributing ideas and suggestions pertaining to sexual and reproductive health rights to be incorporated in newly drafted legislations.
  • Building and presenting sound recommendations, which would assist the understanding and development of the issue at national as well as SAARC Regional level.

13th SAARCLAW Conference and 10th SAARC Chief Justices’ Conference

SAARCLAW is striving to bring the Legal Fraternity in South Asia together. The Legal Community of SAARC region has explored the possibility of enhancing connectivity in SAARC through law, justice, good governance and development. SAARCLAW Conference and Chief Justices Conference is one of the major steps of SAARCLAW to turn the vision and mission of the organization into reality. SAARCLAW Nepal organized 13th SAARCLAW Conference and 10th Chief Justices Conference on the 5th-6th March 2016 at Hyatt Regency, Kathmandu, Nepal. The conference was inspired by the theme of SAARC Conference of head of the states and government that was held in February, 2015 at Kathmandu. The theme of the conference was “Connecting SAARC through Law, Justice, Good Governance and Development”. The conference was attended by the Chief Justices or its representatives from and the legal fraternity from South Asia.

International Seminar on Sharing Of South Asian Experiences For Constitution Building In Nepal”

SAARCLAW, SAARCLAW Nepal Chapter and the Nepal Law Society in partnership with the International IDEA held a regional seminar on “Sharing of South Asian Experiences for Constitution Building in Nepal” on 12-13 April, 2014 in Kathmandu Nepal.  About 60 different experts attended the regional workshop. India – 3 experts; Bhutan – 3; Pakistan – 3; Sri Lanka – 3; Maldives -1; Afghanistan – 1; Bangladesh – 3; and Nepal – 40.  H.E. Arjun Bahadur Thapa, Secretary General of SAARC  attended the event along with Hon’ble Mr. Kalyan Shrestha, Justice, Supreme Court, then Chairperson, SAARC Law Nepal Chapter and now President, SAARCLAW;  Rt. Hon’ble Subash Chandra Nemwang, Chairperson, Constituent Assembly, Nepal; Rt. Hon’ble Chief Justice Mr. Justice Lyonpo Sonam Tobgye, Chief Justice of Bhutan and then President of SAARCLAW; Rt. Hon’ble, Acting Chief Justice Mr. Damodar Prasad Sharma, Supreme Court, Nepal; Senior Advocate Mr. Komal Prakash Ghimire, Chairperson, NLS; Ms. Leena Rikkila Tamang, Director for Asia and the Pacific, International IDEA; and Mr. Hemant Batra, Secretary General, SAARCLAW.

Talk Program On “Independence Of Judiciary:  Issues And Challenges from Finland Perspective” (January 17 – 2010)

One day workshop on the above topic was organized at Hotel Himalaya, Lalitpur.  This program was jointly organized in collaboration with Nepal Law Society/ SAARC Law Nepal / International IDEA.  The program was held on January 17 – 2010.  The program was chaired by Hon’ble Justice Kalyan Shrestha, Supreme Court and Chairperson, SAARC Law Nepal. Keynote Speaker of the program was Justice Pekka Hallberg, President of the Supreme Administrative Court of Finland.  Mr. Purna Man Shakya, Constitutional Expert commented on the views of the keynote speaker. General discussion was followed by remarks from the Chair.  The program ended with Cocktail Reception and Dinner.

Half Day Workshop on Managing Transition through New Constitution: Issues and Aspirations

Nepal is passing through a constitution making process.  The constituent assembly has already declared that the new constitution would be Federal Democratic Republic Constitution.  In the process of constitution making some mile stones have already been achieved. Transitioning from unitary to federal set up is going to be a challenging task as Nepal has no past experience on federal system.  Hence, SAARCLAW organized a discussion on the issues of transition as it is going to be very important for the success of the new constitution on 6th November, 2009.  Hence a joint program on the topic of transition was organized.  It was co-hosted by Consortium of Constitutional Experts.  The topics for discussion was on transition issues from the perspective of constitution and law, territory and population, security, social justice and finance.  Later, report was prepared for circulation to CA members. This workshop was successful in achieving following objectives in constitution making process:

  • To sensitize the importance of transition provisions in constitution drafting process
  • To discuss the possible provisions for inclusion in new constitution for managing transition.
  • To educate the CA members about the challenges of transition from different perspective.

The program was held in Hotel Annapurna on 6th November 2009 and it was attended by Honorable Constituent Assembly members, Lawyers, Judges and Political Scientists.

SAARCLAW Nepal organized 8th SAARCLAW Conference and 5th SAARC Chief Justices’ Conference on 22nd-24th September, 2000 at Hotel Soaltee Crowne Plaza. The theme of the conference was Good Governance for Development: Challenge of the New Millennium.
